Terms of Service

These Terms of Service (“Terms”) govern your access to Fundraiser Command at fundraisercommand.com and its related storefronts, organization portals, and services (collectively, the “Service”). The Service is operated by Detroit Decal & Apparel, LLC (“Company,” “we,” “us,” or “our”).

By creating an account, submitting a campaign, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About Fundraiser Command

Fundraiser Command helps participating organizations manage merchandise fundraising programs, including storefronts, campaign information, order reporting, contributions, and payout requests.

Unless expressly stated otherwise, Fundraiser Command is a commercial fundraising and merchandise platform. We do not represent that participating organizations are registered charities or that purchases qualify as tax-deductible donations.

2. Eligibility and Organization Authority

You must be at least 18 years old to create or administer an account, establish a campaign, or submit payout instructions.

If you act on behalf of an organization, you represent that you have authority to accept these Terms, provide its information, authorize use of its branding, and manage the activities permitted by your account role.

You must provide accurate information and keep it current. Approval of an access request does not independently verify your employment, membership, or authority.

3. Accounts, PINs, and Access

You are responsible for protecting your login credentials and PIN and for activity you authorize through your account. Do not share credentials or use another person’s account without authorization.

Organization owners, managers, and other authorized administrators may approve or remove users and manage access according to their assigned permissions. Your access may change if your relationship with an organization changes.

Notify us promptly if you suspect unauthorized access. We may restrict access when reasonably necessary to protect accounts, investigate misuse, or maintain security.

4. Campaign Setup and Organization Responsibilities

Campaigns are subject to our acceptance and any applicable written campaign agreement.

Participating organizations are responsible for:

We may decline or remove campaigns involving misleading claims, unauthorized branding, unlawful activities, or content that violates these Terms.

5. Pricing and Fundraising Contributions

Product prices and applicable shipping charges and taxes are shown during checkout.

The contribution earned by an organization is determined by its approved campaign terms. Contributions may be calculated as a percentage of eligible sales, a fixed amount per item, or another agreed method. No universal contribution rate applies unless expressly stated.

Campaign terms should identify the contribution calculation, treatment of discounts and refunds, applicable deductions, and payout schedule. Taxes and shipping charges do not generate a contribution unless the campaign agreement expressly includes them.

Campaign goals, projected earnings, and estimated contributions are informational and are not guarantees of sales or payment.

6. Reporting and Payouts

Dashboard figures may be provisional and may depend on data received from Shopify, payment processors, shipping providers, and other connected services. Updates may be delayed, incomplete, duplicated, or corrected during reconciliation.

A displayed balance or submitted payout request does not guarantee immediate payment. Payouts are subject to the applicable campaign agreement, reconciliation, receipt of customer payments, and any disclosed approval requirements.

Refunds, cancellations, chargebacks, fraudulent transactions, and reporting errors may reduce eligible contributions. We may temporarily hold the disputed portion of a payout while investigating a specific issue and will provide an explanation.

If an overpayment occurs, we will explain the correction and arrange repayment or an adjustment to future payouts, consistent with the campaign agreement and applicable law.

7. Orders, Production, and Shipping

Product descriptions, sizing information, and production estimates are provided on the applicable storefront. Buyers are responsible for reviewing their selections and shipping information before submitting an order.

Custom merchandise may enter production shortly after purchase. Changes or cancellations may not be possible once production begins.

For presale campaigns, production may begin after the campaign closes. Unless expressly guaranteed in writing, production and delivery dates are estimates.

Colors and placement may vary reasonably between digital previews and finished products. This does not excuse materially incorrect, defective, or misrepresented merchandise.

Shipping charges, delivery options, and applicable return or refund policies are disclosed through the storefront or checkout. These Terms do not override rights available under applicable consumer protection laws.

8. Returns and Order Problems

The return and refund policy presented for the applicable storefront governs merchandise purchases, subject to applicable law.

Contact us promptly about damaged, defective, missing, or incorrect items. Include your order number, a description of the issue, and photographs when relevant.

An organization’s fundraising contribution may be adjusted when an associated order is refunded, canceled, or charged back.

9. Submitted Materials and Intellectual Property

You retain ownership of materials you submit. You grant us a nonexclusive license to host, reproduce, resize, display, and use those materials as reasonably necessary to operate, promote, produce merchandise for, and fulfill your approved campaign.

You represent that you have the rights and permissions necessary for these uses. We will not use organization branding to imply an unrelated endorsement.

Except for user-submitted materials and third-party content, the Service’s software, branding, designs, and other content belong to the Company or its licensors. You may not copy, resell, or exploit them without permission.

10. Acceptable Use

You may not:

11. Privacy and Communications

Our Privacy Policy explains how we handle personal information.

We may send communications necessary to operate the Service, including access decisions, account notices, order updates, campaign notices, and payout information.

Marketing communications are subject to available unsubscribe options and applicable consent requirements. Receiving essential account or order notices does not require agreement to receive marketing.

12. Third-Party Services

The Service uses or connects to third-party services, which may include ecommerce platforms, payment processors, hosting providers, and shipping services.

Those providers may have separate terms and privacy policies. We cannot guarantee their uninterrupted availability or the accuracy of information they supply.

13. Suspension and Termination

You may stop using the Service at any time and may contact us to request account closure.

We may suspend or terminate access for material violations of these Terms, suspected fraud, security concerns, or legal requirements. Where practical, we will provide notice and an opportunity to resolve the issue.

Ending access does not cancel existing purchase obligations or eliminate contributions properly owed. Outstanding orders, adjustments, and earned payouts remain subject to applicable agreements and reconciliation.

14. Disclaimers and Liability

To the extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted operation, error-free reporting, or a particular fundraising outcome.

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses arising from use of the Service.

Our aggregate liability for claims relating to the Service will not exceed the greater of $500 or the amount you paid directly to us for the affected services or products during the 12 months preceding the event giving rise to the claim.

These limitations do not reduce properly owed campaign payouts, required refunds, or liability that cannot lawfully be excluded or limited, including liability for fraud or willful misconduct.

15. Governing Law and Disputes

These Terms are governed by Michigan law, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Please contact us first so we can attempt to resolve a concern. Unless applicable law provides otherwise, disputes will be brought in a court with appropriate jurisdiction in Michigan. Nothing in these Terms removes nonwaivable consumer rights.

16. Changes and Order of Precedence

We may update these Terms and will revise the effective date when we do. For material changes, we will provide notice through the Service or another appropriate method and obtain additional agreement where required.

Changes will not retroactively alter earned contributions or accepted order terms without agreement.

If a signed campaign agreement conflicts with these Terms, that agreement controls for the specific subject addressed.
